, Calif. – A man who was struck and seriously injured by a garbage truck on January 22 in San Jose is dead, according to the California Highway Patrol.

Silvino Eloy Garcia was struck and killed by a garbage truck at about 6:11 p.m. on Monday, January 22 in the area of Mckendrie and Elm Streets.

According to the San Jose Police Department, Silvino Garcia was hospitalized and succumbed to his injuries on January 26, four days after the incident.

Preliminary investigation revealed that the garbage collection truck was turning onto McKendrie Street from Elm Street when it struck Garcia who was crossing McKendrie at an unmarked crosswalk.

The incident remains under investigation.
