If a pedestrian accident is caused by a driver's negligence, the victim or their next of kin may seek compensation from the driver or their insurance company.
A pedestrian may also be held liable in case the crash was caused by the pedestrian's actions. However, it is important to note that California is a comparative fault state, meaning if the pedestrian was partially at fault, they may still have a chance to recover damages from the at-fault driver.
