Generally, a wrongful death claim must be proven in one of three ways:
First, it must be shown that the defendant owed the deceased person a duty of care.
Second, it must be proved that the defendant breached that duty by negligence or wrongful conduct.
Third, it must be demonstrated that that breach of duty directly resulted in the death of the deceased person.
Wrongful death cases are special types of personal injury claims that arise when a victim would have been entitled to file a personal injury lawsuit had they survived.
