California Pedestrian Accidents

Accidents involving pedestrians usually result in severe injuries or death. Victims of pedestrian accidents sustain internal injuries, broken bones, as well as cuts and bruises. Internal injuries and broken bones can potentially cause death or incapacitation if not treated quickly.

The common causes of most of these accidents include failure to yield to pedestrians at crosswalks, distracted driving, speeding, drunk driving, reckless driving, poor visibility, wrong-way driving, and failure to observe the highway code. Pedestrians are also advised to use designated crosswalks when crossing streets and sidewalks when walking along the streets for their safety.

The law requires motorists to slow down as they approach crosswalks, whether marked or unmarked. They are also expected to yield the right-of-way to pedestrians at controlled intersections. In the event of a pedestrian accident, the authorities will carry out an investigation to establish if the driver may have violated these traffic rules. The authorities may conduct a sobriety test on the driver to establish if the motorist had been driving under the influence of drugs or alcohol

While the accident report above does not give a clear picture of how the accident occurred, Pacific Attorney Group's managing attorney P. Mark Shayani believes that a separate and independent investigation into the accident is crucial. “An attorney will investigate, research, and review every case thoroughly and explain to clients their rights and answer all their questions fully,” he said.
